Terms of Service — AURA Dance Studios App

These Terms govern your use of the AURA Dance Studios mobile app (the "App") and the booking of classes and events through it. By creating an account or using the App, you agree to these Terms. Please read them alongside our Privacy Policy.
1. Who we are
The App is operated by James Cutler Dance Ltd, a company registered in England and Wales (company number 16261978), registered office 28-30 Lincoln Road, Birmingham, England, B27 6PA ("we", "us"). Classes and events booked through the App are provided by AURA Dance Studios ("the Studio"), which is a trading name of James Cutler Dance Ltd. The App is built and provided on Studio Pilot (thestudiopilot.app), our dance-studio app platform, which is also operated by James Cutler Dance Ltd. 2. Your account
- You must be at least 18 to create an account, provide accurate information when you register, and keep it up to date.
- You are responsible for activity under your account and for keeping your login secure.
- You may add other people to your account (for example a partner or a child) in order to book classes for them. By adding someone, you confirm you have the authority to do so and to provide their information, and you are responsible for bookings made for them.
- For anyone under 18, only a parent or guardian may create the booking and provide their details.
- You may link your account with a partner's account (Profile → People). Once linked, you can each see the other's bookings and book classes and events for each other — and, while your link's dependant-sharing setting is on (a single shared setting either of you can switch on or off at any time), for each other's children. Whoever makes a booking pays for it, with their own payment method. Either of you can end the link at any time, which stops all sharing going forward.
- The Studio may ask you to accept a participation waiver before your first booking.
3. Booking classes and events
- Class and event availability, times, and prices are shown in the App and may change.
- A booking is confirmed when you complete it in the App (either by paying or by selecting a pay-on-arrival option, where offered).
- Where a class has limited capacity, a place is only secured once your booking is confirmed. If a class is full you may be able to join a waitlist; a waitlist place is not a booking.
- You agree to attend the specific class or event booked, for the person the booking is made for.
4. Prices and payment
- Prices are set by the Studio and shown in the App. Different classes and events may have different prices.
- You can pay by card in the App or, where the Studio allows, pay by cash or card on arrival.
- In-App payments are processed by our payment provider, Stripe. We do not store your full card details.
- You can choose to save a card for faster checkout. Your card is stored securely by Stripe; we keep only a summary (brand, last four digits, expiry). You can replace your saved card in the App at any time. To remove your saved card entirely, contact us at admin@thestudiopilot.app; it is also removed automatically if you delete your account.
- Where class packs, courses, promotional codes, loyalty rewards, or other offers are available, any specific conditions (such as which classes they apply to) are shown at the time.
5. Memberships
- If the Studio offers memberships, the price, billing period, and what each tier includes are shown in the App before you subscribe.
- Memberships renew automatically and are billed to your saved card until cancelled. If you replace your saved card, future renewals use the new card. You can cancel in the App; your membership then runs to the end of the period you have already paid for and does not renew.
- If you upgrade or change a membership, any adjustment to the price (including a pro-rated charge) is shown to you for confirmation before you are charged.
- If a membership payment fails, the Studio may pause or end the membership's benefits until payment is made.
6. Gift vouchers
- Gift vouchers can be bought in the App and hold a monetary balance redeemable against the Studio's classes and events through the App.
- Vouchers are not exchangeable for cash and do not expire. Any other conditions are shown when you buy.
- If a booking paid (fully or partly) with a voucher is cancelled and refunded, the voucher portion is returned to the voucher balance.
7. Cancellations, refunds and transfers
- The Studio sets its cancellation window, which is shown in the App.
- Within the applicable window you may, depending on the option offered: reschedule a class booking to another date of the same class yourself, or request a refund. Refund requests are reviewed and, if approved, refunded to your original payment method (or voucher balance, where a voucher was used).
- Rescheduling moves a booking to another date of the same class. Event bookings cannot be rescheduled, and bookings made using a membership are cancelled and re-booked rather than transferred.
- Course places are a fixed block booking and are non-refundable once purchased; cancelling a course place forfeits it. This does not affect your statutory rights.
- The Studio operates a friendly, flexible approach and may use discretion in individual cases.
- Refunds apply only to payments made through the App. Payments made by cash or card on arrival are handled directly with the Studio.
8. Your 14-day cancellation right (memberships, vouchers, packs and courses)
- When you buy a membership, gift voucher, class pack, or course in the App, you have a legal right under the Consumer Contracts Regulations 2013 to cancel within 14 days and receive a refund.
- By starting your membership, or by using a voucher, pack, or course place within those 14 days, you ask us to begin providing the service straight away. If you then cancel during the 14 days, we will refund you less a reasonable amount for what you have already used, and the right ends once the service has been fully provided.
- This 14-day right does not apply to bookings for a specific class or event on a set date, which are leisure-activity bookings governed by the cancellation window in section 7.

9. No-show fees
- If the Studio operates a no-show fee, the amount is set by the Studio. You can ask the Studio for its current no-show policy at any time.
- By saving a card, you authorise the Studio to charge the stated no-show fee to your saved card if you miss a booked class without cancelling it, in line with the Studio's no-show policy. You can withdraw this authorisation at any time by removing your saved card (see section 4).
10. Attendance and conduct
- Please arrive on time and follow reasonable instructions from Studio staff.
- We may refuse or cancel a booking, or ask someone to leave, in cases of unsafe, disruptive, or inappropriate behaviour.
- You take part in classes and events at your own risk and should not take part if a medical condition makes it unsafe to do so. If in doubt, seek medical advice first.
11. Reviews and content you post
- If you attended a class, you may be able to leave a rating and review. Reviews must be honest, respectful, and free of offensive or unlawful content.
- You grant us and the Studio permission to display your review in the App. The Studio may moderate or remove reviews that break these rules.
12. Notifications
With your permission, the App may send you notifications such as booking confirmations, reminders, class changes or cancellations, prompts to rebook a class you recently attended, and news about events. You can turn notifications off at any time in your device settings, and opt out of rebook prompts and non-essential messages in the App.
13. Acceptable use
You agree not to misuse the App, including attempting to access other users' data, disrupting the service, or using it for any unlawful purpose.
14. Studio-posted content
Some content in the App — including announcements, photos, and posts in the updates/news feed — is created and published by the Studio. The Studio is responsible for ensuring it has the necessary rights and consents for anything it posts. In particular, where the Studio publishes any image of a child, it is responsible for obtaining appropriate consent from a parent or guardian. (For the AURA Dance Studios app the Studio and the App operator are the same company; this section also applies where the App is used by other studios under their own branding, in which case that studio alone is responsible for the content it posts.)
15. Deleting your account
You can delete your account at any time in the App (Profile → Delete account). Deletion is permanent. Any active membership is cancelled, and anonymised records of past payments are kept where the law requires (see our Privacy Policy for details). Gift voucher balances you have bought for others remain valid for the recipient. If you are the sole owner of a studio on the platform, you will first need to transfer ownership to someone else before your account can be deleted.
16. Availability and changes
- We aim to keep the App available and working but cannot guarantee it will always be uninterrupted or error-free.
- We may update, suspend, or withdraw features, and may change these Terms for a valid reason (for example a change in the law, a new feature, or a change to how the service works). If a change significantly affects you, we will give you reasonable advance notice in the App, and if you have a paid membership you may cancel it before the change takes effect without penalty. The "last updated" date shows when these Terms last changed.
17. Our responsibility
- Nothing in these Terms limits liability where it would be unlawful to do so (including for death or personal injury caused by negligence, or for fraud), or affects your statutory rights as a consumer.
- Otherwise, we are not responsible for losses that were not reasonably foreseeable, or that arise from circumstances outside our reasonable control.
18. Governing law
These Terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales (if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts).
